ฟ้อง

ถ้าศาลเห็นว่า ข้อเท็จจริงตามฟ้องนั้นโจทก์สืบสม แต่โจทก์อ้างฐานความผิดหรือบทมาตราผิด ศาลมีอำนาจลงโทษจำเลยตามฐานความผิดที่ถูกต้อง

If the court finds that the proof [presented by] the prosecutor is in line with the facts according to the charge but the prosecutor cited a wrong type of offence or [wrong] figure of section, the court has the power to impose a penalty upon the defendant in accordance with the correct type of offence.

มาตรา ๑๒๐ ห้ามมิให้พนักงานอัยการยื่นฟ้องคดีใดต่อศาลโดยมิได้มีการสอบสวนในความผิดนั้นก่อน

Section 120 No public prosecutor shall file a charge [instituting] any case with the court without having conducted an inquiry on the [relevant] offence first.

ให้ผู้รักษาเมืองกรมการรับฟ้องแล้วรีบบอกส่งฟ้องกับตัวโจทย์มากรุงเทพมหานครโดยเร็ว

The person in charge of the town [or] the commissioner [of the same] shall accept the complaint, and without delay inform Krung Thep Maha Nakhon [of the matter, and] forthwith send the complaint as well as the person of the complainant in [to Krung Thep Maha Nakhon].

ในคดีที่โจทก์ฟ้องเรียกค่าเช่าหรือค่าเสียหายอันต่อเนื่องคำนวณถึงวันฟ้อง เมื่อศาลเห็นสมควร ศาลจะพิพากษาให้ชำระค่าเช่าและค่าเสียหายเช่นว่านี้จนถึงวันที่ได้ชำระเสร็จตามคำพิพากษาก็ได้

In the case where the plaintiff institutes [an action] claiming rent or damages which are continuing, calculated up to the date [the action is] instituted, the court may, as the court deems appropriate, give a judgment awarding the payment of such rent and damages up to the date [they are] paid completely in accordance with the judgment.

When there has been the withdrawal of a plaint or when the court has decided that the plaint be dismissed without prejudice to the right of the plaintiff to institute the case again..., the court shall have the power to order the return of the court fees in whole or in part to the party...

มาตรา ๒๘ บุคคลเหล่านี้มีอำนาจฟ้องคดีอาญาต่อศาล (๑) พนักงานอัยการ (๒) ผู้เสียหาย

Section 28 These persons have the power to bring criminal cases before the court: (1) public prosecutors; (2) the victims.

In that year, there happened to be someone accusing Chao Nanthasen, ruler of the Lan Chang City of Wiang Chan, and Phra Borom Racha, ruler of Nakhon Phanom Town, of plotting treason together.
